raising major concerns for fewer crews on the scene right now. cbs 5 reporter cate caugiran is live with video. >> reporter: frank and michelle, that gushing water actually slammed into the scaffolding of the building behind me. you can see that damage there. you can see part of the beam has been bent in and that's why the roads are blocked, because authorities are right now trying to assess if that scaffolding i safe. video from earlier shows gushing watertown 40 feet high. water at up to 40 feet. they were trying to pull over a driver for a minor traffic violation, he fled and crashed into a hydrant causing the water break. police took the driver into custody suspected of dui and we don't know at this point if the driver sustained any injuries.

back out live, essex street off folsom is blocked. if you are going to the bay bridge, you have to find a different route. a firefighter said that they are going to assess the safety of that scaffolding and once they find out it is safe they will reopen these roads hopefully that can be soon. reporting live in san francisco, cate caugiran, cbs 5. an on-ramp to the bay bridge is closed not making many morning commuters happy. >> no. not at all. if you are trying to access the lower deck of the bay bridge it's blocked off because of the accident. use 1st instead. the good news it's the noncommute direction so hopefully traffic won't be too busy on the lower deck of the bay bridge at the skyway. we are taking a live look at the area there off the freeway. traffic extra volume on that westbound side coming off the upper deck of the bay bridge. no metering lights though as you work your way towards the toll plaza. elsewhere, if you are trying to take bart or ace, everything is right on time. caltrain, ferries looking good. muni no major delays yet so

because of that accident, the outbound treasure island bus may be affected. probably they will reroute the first as well because of the essex street ramp being blocked. westbound 580 at airway looks like an accident stuck in lanes with a bit of a backup slow out. altamont pass better once you hit 680. east 580 north greenville to north flynn roadwork should be there until 11:00. so expect delays. that's a look at traffic. here's lawrence. >> all right, gianna. i know you're going to be disappointed but no rain around the bay area today. we are drying things out, outside. still some fog as we got a lot of moisture on the ground left from those storm systems rolling through california. it looks like most of the stormy weather now headed eastward. we'll dry things out over the next couple of days. really the main weather concern over the next few days will be some of that dense fog late night and early-morning hours. outside skies are mostly cloudy, mild temperatures, 50s across the board, 56 degrees in san jose. 54 in san francisco. and 56 in livermore. i think as we head toward the afternoon we'll find some partly cloudy skies, 60s into

much of the south bay. heading to the east bay may take longer for the low clouds and fog it break up. so plan on upper 50s and low 60s. and then inside the bay, you will find about 60 degrees in oakland. 59 in san francisco. and about 59 degrees also in sausalito so warr weather is on the way in time for the weekend. more coming up. >> thank you. a deadly fire is under investigation here in san francisco in the ingleside heights neighborhood. fire started about 8:30 last night at the home on saint charles avenue. one person was found dead inside that home. a lot of questions this morning about pleasant hill's second homicide of the year. deputies found a body near interstate 680 and concord avenue around 9:30 last night. no information on the victim, suspect or motive. the first homicide was on february 10 when a 21-year-old man died during a drive-by shooting. police say a missing california woman has been found alive but her boyfriend did not

survive. the pair from sacramento county went missing during last week's storm. it appears their car got stuck in the snow off highway 88 in alpine county. rodrick clifton and paul that lane were last seen at a 7- eleven. paula was found by a family method last night walking outside of a car on the highway. she was then taken to the hospital with frostbite. authorities have identified a body found in the area as rodrick clifton. police say it appears clifton went to get help and never came back to the car. >> they may have been sightseeing and got stuck in the snow. reports are that they may have slept in the vehicle for at least one night. rodrick left the vehicle it seek help and when he did not return, paula left to seek help. >> paula is in stable condition and expected to make a full recovery . oakland police have fended off the feds. now a judge needs to sign off on this last-minute deal with

civil rights attorneys. the much criticized police force agreed to a compliance director appointed by a judge and paid for by the city. cbs 5 insider phil matier says both sides can claim a partial victory. >> the plaintiffs will now have someone within the department answerable to the court to make sure that changes are made. most importantly, what they avoid is a complete federal takeover something that would be an embarrassment for the city and could also lead to a judge telling them that they don't have enough cops and ordering them to hire more. >> according to the "oakland tribune," oakland will be the city in the nation -- the first city in the nation to have its police command staff under the authority of a court-appointed director. san francisco supervisors are considering a pilot program to allow some police officers to carry tasers. the board committee meets about that this morning. the coalition on homelessness plans to protest though. it says the introduction of tasers increased deaths at the hands of officers.

some other bay area headlines now on this thursday. candles and flowers sit at the site where a bicyclist was gunned down near a berkeley school yesterday. family and friends believe the victim, 50-year-old pamela mullins, was riding her bike home tuesday night when she was shot and killed. she was just 100 feet from her apartment. police have not released any suspect information. and a series of robberies at the carquinez bridge toll plaza is apparently solved. california highway patrol planning a news conference this morning to announce the arrest of suspects in the case. the robberies happened earlier this year. if you haven't had fresh crab this season, it might be too late. cbs 5 reporter anne makovec is at san francisco's fisherman's wharf where the crab boats are idle. good morning, anne. >> reporter: these things have a way of working themselves out. it is an issue of economics, the law of supply and demand. but boy, i was back here in mid- november, when the season started. this place was alive with

enthusiasm and now this strike has all boats docked. no crab are being caught in the san francisco bay as we speak. before the season started, fishermen and wholesalers had agreed to a price of $3 a pound for fresh dungeness crab, a little higher than normal. last year it was $2.25. fishermen said they needed more money because there were fewer crabs in the bay and the higher price of fuel. fish brokers say demand is down so they only want to pay $1.80. now that both are idle supply is down and caught in the middle of all this people who like to eat dungeness crab. some retailers say their tanks are empty. it's the law of economics so i think it will balance out. i don't know how long that will take. it's san francisco bay that is participating in the strike as well as half moon bay and bodega bay. live on fisherman's wharf anne makovec, cbs 5. new this morning, duchess of cambridge is resting at the kensington palace now after

altamont pass. eastbound side of 580 also dealing with a few brake lights. ongoing roadwork from greenville to north flynn. they are hoping to wrap it up before 11:00 but that's the scheduled time it's supposed to be there. 880 has been a nice ride for most of the morning. here's a live look. extra volume both directions but overall an easy commute between 28 and the maze. looks like san jose starting to see a few brake lights for the morning commute. northbound 101 slow and go through san jose near mckee. we are also not seeing brake lights along 280. that doesn't get under way for another 30 minutes. guadalupe parkway looking good. highway 17 not showing any problems. extra volume though as you work your way through milpitas. we are seeing a few extra cars westbound 237 from 880 to 101. still about a 7-minute ride there and antioch we have some roadwork on the eastbound side that's been cleared westbound though lots of brake lights as you work your way through there. gets a lot better on the eastshore freeway. that's a look at the morning drive. let's check the forecast. lawrence? >> gianna, i love the rain. but even i'm looking forward to this break in the stormy weather. outside, still a lot of raindrops left behind and that

moisture in the atmosphere skies are mostly cloudy this morning. and some thicker fog showing up at some of the valleys so watch out for that traveling around the bay area today. still, that will begin to break up in the latter part of the afternoon. temperatures right now fairly mild in the 50s. 55 in san jose. 54 in san francisco. and 56 in livermore. as you head around the bay area, thick fog probably the main concern the next couple of days at least into the late night and early-morning hours. by the afternoon partly cloudy skies and a dry weather pattern setting up now not only for today but for the foreseeable future. high pressure will sneak in here. the storm clouds moved to the east this ridge is going to build in over the next couple of days. looks like we could see an offshore wind toward the latter part of the weekend. we are seeing delays at sfo to 48 minutes because of low cloud deck early on but by the afternoon that should give way to sunshine. around the country mostly cloudy skies in houston and cloudy into denver 53 degrees. a cool 47 in chicago and 45 degrees but mostly sunny in new york. low clouds and thick fog early on today that should begin to break up throughout the day and

by the afternoon a little bit of sunshine sneaking through. temperatures going to stay fairly mild in most spots but we'll see a return probably of some low clouds an thick tule fog in the valleys tonight and tomorrow morning. temperatures in the 50s and 60s in the south bay. 50s into antioch. probably low 60s into livermore and also walnut creek. and inside the bay sunshine this afternoon and a couple of passing clouds. and temperatures in the 50s and 60s. next couple of days, we are going to see some decent weather. it should stay dry. warmer as we head in towards sunday and monday. we'll stay dry to the middle of next week. back to you. >> thank you. a phone call between president obama and house speaker john boehner may be a positive sign in all of this "fiscal cliff" drama, they spoke yesterday raising hopes that formal talks will resume on how to to avoid across-the-board spending cuts and tax increases. we have been saying this for weeks. they will kick in if a budget

agreement is not reached by year's end. a number of state lawmakers had their cars fixed and you paid for it. lawmakers lost the perk of a free car about a year ago at least 37 of them deciding to buy the cars. that was an option. they have been using them when the state sold them. first they had all the cars repaired and maintained at state expense. $78,000 worth of work. >> as a taxpayer, you know, it's my money going to it so it's frustrating. >> doesn't sound fair. we work really hard for our money. >> we do. but a source in the legislature says the work was worth it. the state got more money when it sold the cars that were not bought by the lawmakers but had the repairs done. they got more money for those cars. so i guess it evens out. same-sex marriage is now legal in the state of washington. dozens of gay and lesbians got in line to pick up marriage licenses at the county courthouse of every in seattle. governors signed the measure into law yesterday. the state has a three-day

officers. this happened just before 4:00 this morning. police say officers were trying to pull over the driver for a minor traffic violation. and then it ended in that watery mess up to 50,000 gallons of water out on san francisco streets. the driver was taken into custody. firefighters and police have left is the scene. contractors are waiting for the scaffolding contractor to come and fully assess the damage. you can kind of see how bad it caused that dent into the beams there on that building. it's at the base of the building. again, once the contractor can determine that it is safe, they hope to reopen this road and again, the on-ramp to the bay bridge within the half hour or next hour. reporting live in san francisco, cate caugiran, cbs 5. >> thank you. well, as you just heard from kate there are some issues out there especially in the city. let's kick it over to gianna and find out how the roads are this thursday. >> reporter: in the meantime since you cannot access the bay bridge from essex you want to

use the first street ramp instead to get on the eastbound side of the bay bridge. >> slow heading into san francisco. >> the metering lights are on this morning. you might want to use bart instead. traffic is moving pretty well as far as mass transit goes. traffic slow towards the pay gates at the bay bridge toll plaza. in fact, let's get a live look at conditions. we have our mobile5 unit on an a.c. transit bus cruising around the bay area and you can see traffic really starting to load up there as you work your way towards the bay bridge. slow off the eastshore freeway, as well. but dry conditions this morning for your morning commute, right, lawrence? >> isn't that nice to see a break in all the stormy weather as the storm clouds now finally heading eastward? but leaving behind some raindrops in all that moisture in the atmosphere causing some fog outside. so if you are heading out the door watch out for that. some of that thick into some of the valleys but you can see

root for? >> who are you rooting senator. >> who else would i root for? the game will be dry if you plan to head out. cloudy skies but no rain this morning. going to keep things dry around the bay area for today. but all the raindrops left behind so we're seeing fog out there this morning. temperatures generally in the 50s outside. i think as we head throughout the day we'll enjoy it as the clouds break up a little bit. becoming partly cloudy in the afternoon hours, then the dry weather pattern settling in now not only today but right through the weekend. looks like this weekends we could see some very nice weather. so we are looking dry now. the cold front has moved east. high pressure going to start to lift and build into the bay area the next couple of days maybe even an offshore wind by the latter part of the weekend. delays at sfo 48 minutes because of low cloud cover. traveling around the rest of the country mostly cloudy skies into houston and 73. cloudy in denver, 53 degrees. a chilly 47 in chicago. and 45 degrees but mostly sunny in new york. we are expecting the clouds to

give way to some sunshine this afternoon. at least some partly cloudy skies. and then it looks like we are going to stay dry and other than night and morning low clouds and fog, we are looking at decent days ahead. the temperatures a little cool though, plan on 50s and low 60s. the next couple of days no rain in the forecast. by sunday we get offshore winds going and temperatures soaring up into the 60s. looking good and by the way, if you want to head out to the big game tonight, that's right, the oakland coliseum, it will be a little bit cool. go, raiders! right, gianna? >> i don't know. i'm a charger fan. eastbound bay bridge access from essex is blocked because of an earlier accident where a vehicle took out a hydrant. use 1st as an alternate. not too many delays just yet but heads up there. not the case on the altamont pass. westbound 580 slow-and-go through there. earlier accident at airway has been cleared but you're peretti much stacked up about 28 minutes now to work your way towards 680. seeing delays off the eastshore freeway as well towards the maze. and 880 at whipple northbound had a wreck on the right shoulder that's cleared. southbound slow and go out of hayward as you work your way into fremont. that's a look at your drive. back to you guys. >> all right, gianna. thanks. the music world is mourning the death of jazz pioneer dave brubeck. ♪ [ music ] >> brubeck died yesterday of heart failure on his way to the hospital for a scheduled check- up. he was born 92 years ago today. in concord. his most famous jazz hit was "take 5" from 1959. he learned the piano from his

that would have been enough money to buy yahoo, blackberry maker research in motion and seagate technology. just a rough day for apple on a number of fronts. worries that the ipad is losing more ground to the competition. lower sales of higher margin iphones in the current quarter. also, today, apple and samsung are back in federal court in san jose over their ongoing patent battle. apple down 2% today so far. the labor department a big drop in first time weekly unemployment claims. and for the first time in several weeks, the effects of superstorm sandy largely ruled out. the four-week average at 408,000 is still elevated. most of the year we have seen claims around that 370,000 to 375,000 level which suggests modest growth. we get the november employment growth tomorrow. that's a key factor although again sandy will distort the

numbers. flat start on wall street. investors still looking for some progress. dow down 1, nasdaq down 1, s&p down 1, as well. apple shares down 1.25%. back to you. >> it's 1s across the board. thank you. the new reality in washington state recreational use of marijuana is now legal. hundreds of people showed up at the space needle to celebrate at midnight. voters approved the law last month. adults can now possess up to an ounce of pot. but growing and selling it is still a crime. colorado by the way also legalized recreational use of marijuana but that amendment won't take effect until the governor proclaims that it passed. just two years after arriving in the bay area, the "fresh & easy" market chain could be going away. there are 19 "fresh & easy" markets in the bay area employing about 500 people. the british owner of the

grocery chain says it's under taking a wide-ranging review of the business and that includes potentially selling off the stores. having trouble staying away from sweets while you're on a diet? who doesn't? it may not be your fault after all. research% northwestern university found sweets taste so much better when the person is cheating on a diet. the results show the more guilty you feel, the more pleasure you get from eating the treat. a little drama goes a long way. >> yes. some say it is the perfect gift for the fast food fan who has just about everything. i'm not convinced. but pizza hut has come out with a limited edition perfume. the company's marketing firm jokingly posted a status on facebook in canada asking what people would call a cent that captured the aroma of pizza hut pizza. so many people responded that the company decided hey, let's give it a go. so 110 bottles were produced and handed out to facebook fans in canada because nothing says romance more than a pepperoni pizza. >> who wants to smell like
